These Terms of Use govern your use of marketingmagnet.com (the “Site”), which is operated by Marketing Magnet LLC (“Marketing Magnet,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Information only, not professional advice
The Site shares general information about marketing, websites, search, analytics, and technology. It is not legal, financial, tax, or other professional advice, and results described on the Site are not a promise of the results you will get. Using the Site or contacting us does not create a client relationship. We provide services only under a separate written agreement, and if that agreement conflicts with these Terms, the agreement controls.
2. Using the Site
You may use the Site for lawful purposes. You agree not to:
- Interfere with the Site, its security and bot-protection features, or its hosting, or try to gain unauthorized access to any part of it.
- Test the Site for security vulnerabilities without our written permission.
- Use bots, scrapers, or other automated tools to copy content or collect information from the Site, except for search engines, AI search and answer services, and similar services that follow our robots.txt file.
- Send spam, malware, or unlawful content through the contact form, or use the form to advertise products or services to us.
- Submit anyone else’s personal information without the right to do so, or pretend to be someone else.
3. What you send us
When you send us information through the contact form, you confirm that you have the right to share it. We handle personal information you send as described in our Privacy Policy. Please do not send confidential business information, such as trade secrets or unreleased plans, until we have a written agreement in place; a contact form message does not by itself create a confidentiality agreement. If you send us ideas or suggestions, we may use them without any obligation to you.
4. Our content and trademarks
The Site’s text, graphics, logos, design, and other content, and the Marketing Magnet name and logo, belong to Marketing Magnet LLC or to those who license them to us, and are protected by intellectual property laws. You may view and print pages for your own personal, noncommercial use. Any other copying, adaptation, or distribution requires our written permission.
Other companies’ names, products, and trademarks that appear on the Site, including Google and its products, belong to their owners. Mentioning them does not mean those companies sponsor or endorse Marketing Magnet.
5. Software, plugins, and apps
Any software, WordPress plugin, or app we make available is governed by the license and any separate agreement that comes with it, not by these Terms. These Terms do not grant you a license to any software.
6. Links and third-party services
The Site may link to websites and services run by others. We do not control them and are not responsible for their content, terms, or privacy practices.
7. Disclaimers
The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Site will be uninterrupted, error free, or free of harmful components, or that its content is complete or current.
8. Limitation of liability
To the fullest extent permitted by law, Marketing Magnet will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Site. Some jurisdictions do not allow certain of these limits, so they may not apply to you.
9. Indemnity
You agree to indemnify and hold harmless Marketing Magnet from claims, losses, and expenses, including reasonable attorneys’ fees, that arise from your misuse of the Site or your violation of these Terms.
10. Governing law
These Terms are governed by the laws applicable where Marketing Magnet LLC is organized, without regard to conflict of laws rules.
11. Changes to these Terms
We may update these Terms from time to time. Changes take effect when we post them on this page with a new effective date. Your continued use of the Site after that means you accept the updated Terms.
12. General
If any part of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any part of these Terms is not a waiver. These Terms are the entire agreement between you and us about your use of the Site. You may not transfer your rights under these Terms; we may transfer ours in connection with a merger, acquisition, or sale of assets.
